Terms of Service & User Agreement

Please read these Terms of Service ("Terms") carefully before registering on or using the Tribeyours.com platform ("Platform"). By accessing, registering on, or using the Platform in any manner, you ("User") constitutes your acknowledgment that you have read and understood these terms and thereby, agree to be bound by these Terms and all the applicable laws and regulations.

1. ABOUT THE PLATFORM

1.1 Tribeyours.com ("Tribeyours", "we", "us", "our") is an online platform that facilitates the discovery of social circles and events, enabling users to connect with communities that share common interests. Tribeyours is operated by Tribe Experiences LLP, a company incorporated under the Companies Act, 2013, having its registered office at 42B/306, Kanchan Ganga, 1st Cross Road Lokhandwala Complex Andheri West, 400053 India.

1.2 Events listed on the Platform are of two kinds: (a) "Tribe Events", which are events conceived, organised, and directly managed by Tribeyours.com; and (b) "Host Events", which are events organised, managed, and executed entirely by independent Hosts who have registered on the Platform and been granted Host status. In respect of Host Events, Tribeyours acts solely as a listing and ticketing platform and bears no responsibility whatsoever for the planning, organisation, management, execution, safety, or quality of such events.

1.3 Any registered User may apply to become a "Host" on the Platform. Upon successful verification and approval by Tribeyours of the User's Host profile, the Host may list Host Events on the Platform. Hosts are independent third parties and are not agents, employees, partners, or representatives of Tribeyours. The Host and the Host's registered profile on the Platform shall together be treated as the responsible entity for all matters relating to a Host Event, including legal liability, attendee communication, safety, regulatory compliance, and refunds. Tribeyours provides only the technological infrastructure for event discovery, registration, and payment processing and does not exercise editorial control over Host Event listings.

1.4 Tribeyours reserves the right to reject, suspend, or revoke Host status or remove any event listing at its sole discretion, without notice, where it determines that the listing violates these Terms, applicable law, or the Platform's community standards.

2. ELIGIBLITY

2.1 User must be at least 18 years of age to register on the Platform. By registering, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding contract.

2.2 Persons under the age of 18 may access the Platform only with the verifiable consent of a parent or legal guardian, who shall be bound by these Terms on the minor's behalf.

2.3 Tribeyours.com reserves the right to terminate accounts of Users found to have misrepresented their age. We bear no liability for misrepresentations made by Users regarding eligibility.

3. USER ACCOUNT AND REGISTRATION

3.1 To access certain features of the Platform, you must create an account. User agree to provide accurate, complete, and current information during registration and to keep your account information updated.

3.2 User are solely responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. Tribeyours.com shall not be liable for any loss or damage arising from your failure to maintain account security.

3.3 Tribeyours.com reserves the right to suspend or terminate your account if we have reason to believe that you have provided false information or violated these Terms.

4. PROHIBITED CONTENT AND CONDUCT

4.1 User must not host, display, upload, modify, publish, transmit, or share any content that:

• belongs to another person and to which you do not have any right;
• is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially or ethnically objectionable;
• harms minors in any way;
• infringes any patent, trademark, copyright, or other proprietary right;
• violates any law for the time being in force;
• deceives or misleads any person regarding the origin of such content or knowingly and intentionally communicates any information which is patently false or misleading;
• impersonates another person;
• contains viruses, malware, or any other computer code that may interrupt, destroy, or limit the functionality of any computer resource;
• threatens the unity, integrity, defence, security or sovereignty of India, public order, or the relations of India with foreign States;
• promotes or facilitates any unlawful event, gathering, or activity.

4.2 User also agree not to:

• use the Platform for any commercial solicitation not authorised by Tribeyours.com;
• harvest, scrape, or collect user data from the Platform;
• use automated bots, crawlers, or scrapers;
• attempt to gain unauthorised access to the Platform or its underlying systems;
• engage in conduct that may damage the reputation of Tribeyours.com or its Users.

5. CONTENT OWNERSHIP AND LICENSE

5.1 Tribeyours.com does not claim ownership over User Content or event listings submitted by Organisers.

5.2 All proprietary technology, design, branding, and software comprising the Platform are the exclusive intellectual property of Tribeyours.com and are protected under applicable Indian law. User may not reproduce, modify, or distribute any part of the Platform without express written permission.

6. EVENTS AND THIRD PARTY DISCLAIMER

6.1 The Platform lists two categories of events. Tribe Events are events directly organised and managed by Tribeyours.com; these will be clearly marked as such on the Platform. Host Events are events listed by verified independent Hosts. Tribeyours is not the organiser, co-organiser, sponsor, or host of any Host Event. For Host Events, Tribeyours acts solely as a listing and payment facilitation platform.

6.2 Tribeyours.com makes no representation or warranty, express or implied, regarding:

• the accuracy, completeness, or currency of any event listing;
• the safety, suitability, or quality of any event or venue;
• the competence, credentials, or conduct of any Organiser;
• the fitness of any event for any particular age group, health condition, or purpose;
• whether the Organiser holds necessary permits, licences, or permissions (including police permissions, fire safety compliance, FSSAI licences for food, or Excise licences where applicable).

6.3 Users attend all events, whether Tribe Events or Host Events at their own risk. By RSVPing for or attending any third-party event through the Platform, you acknowledge and accept that:

• Tribeyours.com bears no liability for any personal injury, illness, death, property damage, or financial loss suffered in connection with any Host Event;
• attendees are solely responsible for their personal belongings during any event; Tribeyours shall not be liable for any lost, stolen, or damaged items at any event;
• all disputes arising from Host Events are between the User and the Host; Tribeyours is not a necessary party to such disputes;
• Tribeyours does not conduct background checks on Hosts or inspect event venues prior to listing.

6.4 The Host is solely responsible for planning, organising, managing, executing, and ensuring the safety of their Host Event. Tribeyours provides only the technological platform for event discovery, registration, and ticketing and is not responsible for the quality, safety, legality, or execution of any Host Event in any respect whatsoever.

6.5 The Host and the Host's registered profile on the Platform shall be treated as the same responsible entity for all purposes relating to the Host Event. Any complaint, dispute, claim, damage, or liability arising from a Host Event, including but not limited to event quality, attendee experience, scheduling, representations made by the Host, personal injury, or property damage, shall be the sole and exclusive responsibility of the Host. Tribeyours bears no liability therefor.

6.6 Hosts are solely responsible for obtaining all necessary permissions, licences, venue approvals, police permissions, fire safety clearances, food licences, Excise licences, and any other regulatory authorisations required for their Host Event under applicable law. Listing an event on the Platform does not constitute or substitute for any such permission or approval.

6.7 Tribeyours currently does not charge any commission to Hosts for listing events on the Platform. Ticket revenue, net of applicable payment processing fees, will be transferred to the Host's registered account within 48 hours of successful event completion, provided there are no ongoing disputes, fraud investigations, payment holds, or refund claims outstanding. Tribeyours reserves the right to withhold or adjust payouts where a dispute or investigation is pending, and to recover amounts already transferred if a refund is subsequently granted.

6.8 Any dispute between a User and a Host relating to a Host Event, including but not limited to disputes as to event quality, conduct, scheduling, or representations made by the Host must be resolved directly between the User and the Host. Tribeyours is not responsible for mediating or resolving such disputes and shall not be a necessary party to any proceedings arising therefrom.

6.9 Tribeyours reserves the right to reject, suspend, or remove any Host Event listing without notice where it determines, in its sole discretion, that the listing violates these Terms, applicable law, or the Platform's community standards. Such removal shall not create any liability on the part of Tribeyours to the Host.

6.10 Once a User has registered for an event whether a Tribe Event or a Host Event and payment has been made, no refund shall be granted and no request for refund shall be entertained on grounds of change of mind, personal circumstances, inability to attend, or any reason other than those expressly set out in Clauses 6.11 and 6.12 below. Registration for a paid event constitutes a binding commitment.

6.11 A refund in respect of a Tribe Event shall be granted only in the following circumstances:

• the Tribe Event is cancelled by Tribeyours;
• the date of the Tribe Event is changed by Tribeyours and the registered attendee chooses not to attend the rescheduled event;
• the Tribe Event cannot take place due to a Force Majeure Event as defined in Clause 7.1; or
• such other circumstances as Tribeyours, in its sole and absolute discretion, deems fit to warrant a refund.

Whereas a refund is due under this Clause, Tribeyours shall process the refund within 72 hours or 3 business days of the originally scheduled event date, whichever is later, subject to payment gateway timelines. Tribeyours bears no liability for any delay in credit caused by the User's bank or payment service provider.

6.12 A refund in respect of a Host Event shall be granted only in the following circumstances:

• the Host Event is cancelled by the Host;
• the date of the Host Event is changed by the Host and the registered attendee chooses not to attend the rescheduled event;
• the Host Event cannot take place due to a Force Majeure Event as defined in Clause 7.1; or
• such other circumstances as Tribeyours, in its sole and absolute discretion, deems fit to warrant a refund.

Whereas a refund is due under this Clause, Tribeyours shall use reasonable endeavours to process the refund within 72 hours or 3 business days of the originally scheduled event date.

6.13 All refund requests must be submitted through the Platform within 24 hours of the original event date. Requests submitted after this period shall not be entertained under any circumstances.

7. MISCELLANEOUS

7.1 Tribeyours.com shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including: acts of God; natural disasters (earthquake, flood, fire, cyclone, lightning); epidemic or pandemic; government orders, lockdowns, prohibitory orders, or withdrawal of event permissions or venue licences by any competent authority; riots, civil unrest, or acts of terrorism; failure of power, telecommunications, or internet infrastructure; cyberattacks or third-party technology failures; sudden closure, damage, or evacuation of an event venue ordered by any authority; or any other event of similar nature that could not have been avoided by reasonable diligence. This Clause does not apply to a party's own financial difficulty, negligence, or circumstances that were reasonably foreseeable at the time of contracting. If a Force Majeure Event continues beyond 60 consecutive days, either party may terminate the affected transaction without further liability.

7.2 Tribeyours.com reserves the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

7.3 Tribeyours.com may revise these Terms at any time. The revised Terms will be posted on the Platform with the updated effective date. Continued use of the Platform after such revision constitutes your acceptance of the revised Terms.

7.4 Tribeyours.com will inform Users of material changes to these Terms at least annually, and you will be prompted to re-accept updated Terms upon login where required.

7.5 These Terms shall be governed by and construed in accordance with the laws of India.

7.6 Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between Tribeyours.com and any User or Organiser.
